冷战时期，美苏两大阵营政治对抗（共产主义对抗自由世界），类似中国这种共产国家建立了庞大的针对西方专业图书复印盗版机构，目标是及时引进西方最新学术、技术成果。中国政府经营的全国性盗版体系的大型分支机构位于广州、上海、西安、北京（每本盗版书书末都会标注责任分支机构及内部流通的定价）。1949年至2001年，该套体系对西方出版物的盗印总量远超过中国境内合法专业图书、杂志、资料出版物印量总和。在此期间，中国专业人员参考的专业技术出版物（含辞典等工具书、图书、连续出版物）几乎全部为盗版。在中国政府加入WTO后，该规模庞大的盗版团伙体系被拆解，极少量灰烬（少于拆解前编辑、制版、印刷、发行资产总量2%）被改造为“中国国际图书公司”，正式营业登记，从事版权引进业务。但是由于各国有党营的出版社都具备版权引进的资格，该出版机构的年度生产量在总体图书市场中已经微乎其微（远少于1%），成为历史。 

中国政府对出版内容的生产，尤其是涉及出版物（如书籍、报纸、期刊、音像制品等）的内容制作和发行，实施了严格的管理和控制。这种控制确保了绝大部分出版物来自党委直接控制的党组织或国有单位，并限制了民间及民营企业的资金进入出版内容的生产。以下是中国政府为此设定的几大“护城河”： 

1. 出版资质和许可制度 中国实行严格的出版许可制度，只有取得政府颁发的出版许可证的单位才能从事出版活动。对于出版机构的设立和运营，政府有非常明确的规定：

 • 出版许可证：任何出版物的发行机构必须获得国家新闻出版署（现为国家新闻出版署，原为新闻出版总署）颁发的出版许可证。所有出版物的生产、发行都必须通过有资质的出版单位来进行。民营企业不能直接获得出版许可证，必须依托已有资质的国有出版单位。

 • 民营企业不能独立持有出版资质：根据《出版管理条例》和相关法律法规，民营企业不能独立从事出版活动，特别是在书籍、报纸、期刊等领域，内容生产和发行必须依赖于国有出版单位。民营企业如果想要涉足出版内容，只能通过与国有出版单位合作，以挂靠或其他形式参与内容出版，但不具备独立的出版资质。 

2. “挂靠出版”模式的限制 虽然民营企业不能直接出版内容，但在实际操作中，民营企业可以通过“挂靠出版”或“合作出版”的方式与国有出版单位进行合作。具体操作是，民营企业负责内容制作，而国有出版单位负责审查、出版和发行。但近年来，政府对这种“挂靠出版”模式进行了严格的整顿和限制，防止民营资本通过此类方式绕开审查制度。 

• 清理整顿挂靠出版行为：政府多次开展清理整顿行动，打击利用挂靠出版逃避审查的行为，确保所有出版物中的内容能够受到严格的政治审查和内容把关。 

• 出版单位的审查责任：即使通过挂靠出版的方式，最终负责出版的国有出版单位仍对出版物的内容负有审查和监管责任。这意味着民营企业即便参与内容制作，最终的出版权和审查权依然掌握在国有出版单位手中。 

3. 内容审查和政治把关 中国实行严格的出版内容审查制度，所有出版物在正式出版之前必须经过审查，确保符合国家的法律法规和政治要求。这是中国政府确保出版物掌控在党组织和国有单位手中的重要“护城河”： 

• 政治审查和意识形态控制：所有出版物必须符合中国的政治要求，尤其是在涉及意识形态、政治、历史、文化等敏感领域时，出版内容需要经过多级审查，确保符合党的路线、方针和政策。这些审查工作主要由国有出版单位完成，民营企业无法绕过这一过程。 

• 内容审查制度：出版单位的主编和相关负责人对出版物的内容负有政治责任，他们必须确保出版物的内容经过严格审查，符合国家的规定。出版单位如果违反规定出版了不符合要求的内容，可能会被吊销出版许可证，相关责任人也会受到处分。因此，国有出版单位在内容把关上非常谨慎，确保所有出版物符合国家的意识形态要求。 

4. 出版物的党管制度 中国对出版物实施“党管制度”，即出版物的编制、生产和发行都受到党的直接领导和控制。具体表现为：

复转军人进法院作者： 作者：贺卫方 　　　　两年前，我应邀给某省法官培训班讲课，内容是中国与西方司法制度和司法观念的零星比较。讲课过程中，我表达了对我们国家在选任法官方面一种惯例的不理解：为什么长期以来总是理所当然地把每年从军队复员转业的许多人员安置到法院中？为什么不要求医院安置他们？ 　　 　　　　问题提得似乎有些突兀，也许听课的法官们压根儿就没有把它当成问题，也许在他们看来拿法院跟医院相类比本身便很不伦：这怎么能比呢！医生是人命关天的职业，没有受过专门的训练就给人把脉看病开处方，岂不是江湖骗子？更不消说拿着手术刀的外科医生，什么都不懂，乱割一气，真正是拿人命当儿戏！——我从听众的表情读出了这样的质疑。 　　 　　　　于是，我开始论证法院和医院或法官跟医生之间的可比性。医生固然是人命关天，难道法官这种职业不是人命关天么？差异当然是有的，那就是医生是把将死的人往活里救，法官则经常是把个大活人往阎王那里送。但他们的职业都关乎人命却并无二致。我们古典社会便很注意防止处理案件的官员们“出入人罪”，什么是出入人罪？正是指操生杀予夺权柄的官员们把重罪轻判或轻罪重判，出生入死，上下其手。人头不比韭菜，割下可以重生，或《封神演义》里申公豹先生的那颗脑袋，砍掉还可以再安装；昏官或赃官错判死刑，冤死鬼一命呜呼之后，什么都完了。平反昭雪之类，不过是安慰安慰活人或后人而已。 　　 　　　　法官要处理的事务不仅仅限于刑事方面，正如医生不是每人每天都在急救濒死的病人。巨额财产的归属，未成年人的监护，合同是否应当履行，文章是否构成了对被批评者的诽谤，夫妻还能不能继续住在一个屋檐下，祖传下来的房产能否保全而不被作为“钉子户”沦为推土机下的废墟……所有这些，虽然不直接关系人命，但是，它们对于相关当事人权利的重要性是不言而喻的。 　　 　　　　哦……两种职业的差异还可以指出一点——不过，这一点强调的却是法官更重要的一点——那就是，医生的行为通常只涉及个别病人，他的失误只会给特定病人及其家庭带来损害，然而，法官的失误却会产生更广泛的社会影响。法院不只是纠纷的处理机关，也是宣示国家法律究竟由怎样的规则构成的机关，司法官员行为本身便是在表达着正义的风纪。司法机关的行为是否正当，直接关系到人们对他们所在国家的政治制度的评价，影响到一国社会风尚的趋向。正是由于这个缘故，培根才断言，一次不公正的司法行为比很多次其他不公正行为为患尤烈，因为后者污染的是水流，而前者败坏的却是水源。 　　 　　　　说到这里，法官们似乎同意了法院与医院之间的可比性。但是，另一个问题并没有回答：是的，法院也很重要，甚至对社会有比医院更大的影响，不过，这并不等于说，法官的选任必须像医生那样，先要受过专门的教育。解放军是一所大学校，军人的经历本身就是一种有用的训练。 你怎么能论证法官公正的司法行为一定要跟法律教育不可分离呢？君不见报纸上表彰的法官里许多都是复转军人出身的么？ 　　 　　　　这实在是击中要害的质问。可不是么，我前些年曾对法院系统的一家专业报纸所刊登表彰法官的文章作过一番统计。在迄止1994年6月底出版的共114期报纸中，刊有表扬法官的通讯、特写等共72篇，其中明确提到主人公是复转军人的共18篇，占25％，表明主人公曾受过大学教育的只有5篇，占6.1％ 。给我留下深刻印象的不仅是比例上的这种差异，用语上的区别更是泾渭分明。作者们明显地在向读者传达这样的信息：军人的经历乃是这些优秀法官们得以成功的基础，而那些受过大学教育的人们，他们的四年寒窗却连一个积极因素都算不上。 　　 　　　　这是为什么？难道说实际情况就是如此，中国的司法职业就是离不开军人的气质和作风，现在的大学教育根本无从培育具有良好素质的司法职业群体，还是文章的作者（以及报纸的编者）受到长期流行的某种新闻话语结构的支配，并自觉或不自觉地不断再现和强化着某种固有的意识形态？果真是复转军人更胜任司法工作的话，为什么从八十年代初开始，最高人民法院江华、郑天翔等院长都曾奔走呼号，要求不能让法院再背这样的“包袱”；一次次的最高法院工作报告都不断地强调对在职法官进行学历教育的重要性？与其把不合格的人员放进来之后再费尽气力进行学历教育方面的补课，何如一开始就把门槛垫高，只接受那些受过大学法律教育的优秀毕业生做法官？ 　　 　　　　我坦率地告诉听课的法官们，对于这个问题，自己无法给出一个确定的判断，并试图让大家各自谈谈内心的想法。出乎我意料的是，听众陷入了令人难堪的沉默之中。我甚至从个别法官的眼神中觉察出一丝敌意。见势不妙，我赶快收住话头，告诉他们我非常赞成妥善地安置复转军人，这不仅是因为我自己就是一位复转军人的儿子和另一位现役军人的哥哥（搬出家底是为说明我决无恶意），更重要的是他们为保卫国家，将最美好的青春年华献给了军旅生活，国家和社会有义务在他们离开军营之后有一个好职业。 但是，我还是明确地表达了我的倾向：复转军人不应当成为法官，除非他们从前受过系统的法律教育，并且符合法官任职的其他要求。 　　 　　　　课程结束了，培训班负责人送我一份学员登记表。我发现，整个法官班学员中，复转军人出身的法官占了将近一半。
